The line of the Jack Lynch tunnel in Cork was altered to suit the interests of a local property developer, Mr Gilmartin has claimed.

Mr Gilmartin said the original line of the tunnel was altered to suit the Mahon site owned by property developer Mr Owen O'Callaghan.

Mr O'Callaghan told him this, he said. At the time the two men were discussing a possible business deal involving their respective development lands in west Dublin.

According to the witness, Mr O'Callaghan told him he and the architect, Mr Ambrose Kelly, had "clout" and they would have to be "on board" if Mr Gilmartin wanted to bring to fruition his plans for a massive shopping centre at Quarryvale in west Dublin, he said.

Mr Kelly had to be on board if Mr Gilmartin wanted to "get through" An Bord Pleanála, he said he was told.

Mr John Gallagher SC, for the tribunal, said Mr Gilmartin had not told the tribunal anything about these matters before.

The witness said he believed they belonged to another module of the tribunal's investigations.
