A finance company is seeking summary judgment orders against two brothers over alleged unpaid loans of €4.46 million.

Emberton Finance Ltd has brought its proceedings against businessmen John and Michael Kinsella, both of Tomadilly, Marshalstown, Enniscorthy, Co Wexford.

On Monday Mr Justice Brian McGovern agreed to transfer the case to the Commercial Court.

Brian Conroy, for Emberton, said its application for judgment related to monies advanced to the brothers by Friends First Finance Ltd in June 2008. The monies were to refinance an existing loan concerning 64 acres at New Ross and to buy 158 acres at Ferns, the court heard.

Emberton says the loan, plus associated security, was assigned to it by Friends First Finance Ltd in March 2014.

It claims an agreement had been reached with the brothers at one stage, but had broken down.
