Treasury Holdings Ltd, a property development company, is to appeal to the Supreme Court against a decision to adjourn Treasury's application for the winding up of Lancefort Company Ltd, a company of conservationists.
Lancefort pursued lengthy, costly and ultimately unsuccessful legal proceedings to halt Treasury's plans for a hotel and office development in central Dublin. Treasury claims Lancefort owes it €292,000 (£233,000) from its unsuccessful legal challenge.
In the High Court late last year, Ms Justice Carroll adjourned Treasury's petition for the winding up of Lancefort to yesterday. The judge said she wanted information on the progress of Lancefort's appeal to the European Court of Human Rights against a Supreme Court decision that it had no legal standing to challenge the Treasury development.
Yesterday the judge was told the ECHR had confirmed the matter was pending but that a decision could take years.
Mr Michael Cush SC, for Lancefort, asking the judge for an adjournment to mid-2002, said there would be no gain to Treasury should Lancefort be wound up now. The company had no assets.
Mr Michael Collins, for Treasury, opposed the adjournment application. He said Mr Cush was effectively looking for an indefinite adjournment of the matter.
Ms Justice Carroll said there would be no gain to Treasury through wiping out Lancefort now. She would adjourn the case to early July.
